Content Use, Scraping and Artificial Intelligence Policy

This policy explains how content published on stockholmkendoopen.se may be accessed and used. In this policy, “we”, “us” and “our” refer to Kibo Dojo Kendoklubb.

1. Scope and ownership

This policy applies to text, photographs, graphics, videos, documents, databases, page layouts and other material published on this website, to the extent that we own or are authorised to exercise the relevant rights.

Publishing material on a publicly accessible website does not, by itself, grant permission to collect, store, reproduce, redistribute or otherwise reuse it.

Third-party material remains subject to its owners’ rights and any applicable licence. We cannot grant permission for uses that require another rights holder’s authorisation. This policy does not claim exclusive rights over unprotected facts or information.

2. Ordinary use of the website

You may browse this website and share links to its public pages. Temporary technical copies reasonably necessary to display and use the website in an ordinary browser are permitted.

These permissions do not extend to bulk downloading, systematic collection, independent archiving, republication or use in artificial intelligence systems.

This policy does not restrict service providers carrying out hosting, maintenance, security or other activities on our behalf and with our authorisation.

3. Restrictions on collection, scraping and reuse

Except as permitted by applicable law, expressly allowed by this policy or separately authorised by us in writing, you may not:

  • Scrape, crawl, harvest, extract or systematically collect website content, whether manually or through bots, scripts, APIs or other automated tools.
  • Download, copy, store, cache or archive content beyond what is permitted for ordinary browsing.
  • Reproduce, republish, redistribute, modify, translate, sell, license or otherwise exploit protected content.
  • Incorporate content into databases, datasets, aggregation services, searchable repositories or other collections.
  • Extract or reuse protected database contents in a manner that infringes our database rights, including through repeated or systematic extraction.

These restrictions apply to collection for your own purposes and collection on behalf of another person or organisation, whether commercial or non-commercial, subject to applicable law.

4. Artificial intelligence and machine learning

Subject to applicable law, we do not authorise the collection, storage or use of protected website content for:

  • Creating or enriching AI or machine learning datasets.
  • Training, pre-training, fine-tuning, testing, evaluating or otherwise developing AI or machine learning models.
  • Building embeddings, vector databases or other representations of the content for use in AI systems.
  • Supplying content to retrieval-augmented generation systems, chatbots, AI assistants or automated answer services.
  • Creating collections or archives intended for subsequent AI use or supplying such collections to third parties.

Where our authorisation is legally required, it must be obtained expressly and in writing before the activity begins.

5. Express reservation under the EU Copyright Directive

Under Article 4(3) of Directive (EU) 2019/790 on copyright and related rights in the Digital Single Market, and applicable national implementing legislation, Kibo Dojo Kendoklubb expressly reserves its rights in relation to text and data mining of protected content on this website.

This reservation applies to reproductions and extractions for text and data mining, including those undertaken in connection with AI development or training, to the extent covered by our rights.

Our reservation is also communicated through machine-readable signals, including the tdm-reservation: 1 HTTP response header where provided. Public accessibility and the absence of a technical access block do not withdraw this express reservation.

The statutory exceptions described below remain unaffected.

6. Reference to the EU AI Act

Article 53(1)(c) of Regulation (EU) 2024/1689, the EU Artificial Intelligence Act, requires providers of general-purpose AI models subject to that provision to implement a copyright compliance policy, including identifying and respecting rights reservations made under Article 4(3) of Directive (EU) 2019/790.

This policy and our machine-readable signals communicate such a reservation. Providers subject to that obligation must take it into account in accordance with applicable law.

This reference does not assert that the AI Act prohibits every form of scraping or AI use, or that it creates additional ownership rights in otherwise unprotected material.

7. Statutory exceptions and other permissions

Nothing in this policy excludes or limits uses permitted under applicable law that cannot lawfully be restricted.

In particular, this reservation does not override the exception for qualifying scientific research by research organisations and cultural heritage institutions under Article 3 of Directive (EU) 2019/790, as implemented in national law, where its legal requirements are met.

Other applicable exceptions and limitations, including lawful quotation, remain unaffected. Material expressly released under a separate licence may be used in accordance with that licence.

8. Requests for written permission

Send permission requests to info@kendoklubben.se and include:

  • Your name and the organisation or service you represent.
  • The content you wish to collect or use.
  • The proposed purpose, methods, scale and duration.
  • Whether content will be stored, shared with third parties or used in an AI system.

Permission must be expressly granted in writing before any activity requiring our authorisation begins. It applies only to the content, purposes, duration and conditions specified in that permission.

Silence, failure to respond, previous access or technical availability does not constitute consent.

9. Rights enforcement

Where we believe our rights have been infringed, we may request that the activity stop, seek removal of infringing copies and pursue remedies available under applicable law.

All rights reserved to the extent permitted by applicable law.
